WHERE CAN ONE TURN TO FOR SUPPORT IN BELGIUM WHEN ABUSED BY CORRUPT OR INCOMPETENT NOTARY AGENTS?
Nowhere, it seems. I’ve been recently contacted by another victim of this system, proving to me the helplessness of those who suffer within this system.
A ‘Notary Agent’ or a ‘Notaris’ is a legally recognized, traditionally inherited, position of responsibility in the preparation of important documents and most importantly the sale of real-estate, functions which have become redundant in many other countries, being performed instead by real-estate agents or lawyers. They are legally obliged to help any client who requests their services; they should provide support and assistance to their clients. Unfortunately they’ve developed a reputation which often puts them in competition with real-estate agents where their own personal greed raises its ugly head above the traditional function of service and assistance.
The organization which exists to protect clients from incompetent or corrupt notary agents, known as the ‘Kamer der Notarissen’, consists of members each of whom is a notary agent chosen by other notary agents. I was advised by my current notary agent to send my complaints to them. My lawyer told me that they operate quickly and efficiently against those who abuse their clients. Needless to say, I’ve decided to change lawyers as this organization is clearly corrupt from within and is there to protect its own members rather than the clients who are abused by its members. I’ve been the unfortunate victim of the incompetence of two notary agents, one in Antwerp and one in Ghent (Notaris VAN BAEL et.al. & Notaris POPPE respectively); my valid complaints have been ignored and there is no way for me to be compensated for the year of misery they are responsible for the problems which have STILL NOT BEEN RESOLVED. Yesterday I was contacted by a victim of the Notary Agent POPPE [Noordstraat 6, 9000 Ghent]. I was extremely shocked by the growing evidence demonstrating the complete incompetence of this agency and indifference they continue to show towards their clients. The man who contacted me has been waiting more than a year for the arrangement of papers for his divorce which should have been ready in two weeks. Like me, his problems are still unresolved, and he has also submitted complaints to the ‘Kamer der Notarissen’ without results; this criminal is still abusing his clients and causing enormous misery to the abused parties. How can something like this be allowed to happen? The first port of call for victims is the above-mentioned ‘Kamer der Notarissen’ who can submit complaints via registered post. Because I was unfortunate enough to suffer under the stupid mistakes of two agencies, one in Antwerp and one in Ghent, I sent in two complaints, new links to which I’ve included below. They were both, naturally, ignored, and I’m supposed to accept this fact and put up with the enormous financial and emotional costs to me and those around me.

HOW IS MY NOTARY AGENT [NOT] HELPING ME?
By continuing to work with the notary agent who has caused me, and many others, so much misery. Perhaps that shocks me the most: my notary agent, Henri Meert [Parklaan, Sint-Niklaas], despite the large amount of evidence I’ve sent him and the continued lies that were standard fare to excuse the incompetence of their actions. Because my friends have so much respect for this man, I can only hope that his choice to continue working with this clearly criminal agency arises from a sort of naivety or blind faith in other colleagues who share such an ‘honorable’ profession. For me, the year of misery suffered by another client, the similar set of lies which have been constantly fed to him, and that still have not resulted in a solution to a problem which should have been solved in two weeks, in addition to a complaint to the necessary organization which has had no results, has made the cup run over. There has to be more that can be done to protect the victims of incompetent or corrupt notary agents.
In the name of the Bulgarian owner I’m forced to live in the same house with (which I should have become the complete owner of a year and a half ago) I requested that notary agent Meert rescue him out of the hands of Poppe; although legally obliged to take on any client that applies, he ignored his requests and continues to work with Poppe. The latest communication is that he contacts Poppe once a week to see how things are developing. He seems ignorant to the ugly truth: the notary agent Poppe doesn’t care what happens to his clients and lies constantly to excuse this indifference. Needless to say, in the mail I sent yesterday, I’ve made it clear that he has to make a stand against the criminal actions of this incompetent notary agent and halt further collaboration with him. Henri Meert has a very good reputation and I can only hope that he will make the right moral decision to reject the unacceptable behavior of notaris Poppe; if he doesn’t I’ve suggested that through his passive participation he will become involved in a very dirty criminal case. And I know that if my problem is resolved, it will be thanks to my own efforts and that of the Belgian real-estate agent Jasmina Krabbé and her company Immo2fast4you and despite the total incompetence of notaris Poppe and the passive collaboration of Henri Meert.
